Advice On The Implications Of Separation And Divorce

Divorce Applications

Arrangements For Children

If you have children, you can put a child arrangements order in place setting out details of where they will live and how much time they will spend with each parent.

If possible, the courts prefer that the details are worked out amicably out of court. If you and your child’s other parent cannot reach an agreement, the next stage is to consider mediation. We can discuss going to a Mediation Information and Assessment Meeting or MIAM. This is a meeting where a mediator will explain the process and the potential advantages to you and you can decide whether to go through mediation.

Where an agreement can be reached, this is put into writing and the court asked to approve and seal it, making a binding child arrangements order.

If you and your child’s other parent are not able to agree on child arrangements, the court can be asked to make an order. This is generally a lengthier procedure. We can discuss with you what you might expect from the courts and explain the welfare checklist to you, which is what the courts will use in deciding what order to make.
